The Freedom Universal

The Freedom Universal — A Constitution for a Free, Just, and Prosperous Society

The Freedom Universal is a constitution which consists of the provisions described in this document, including the statement of individual sovereignty, the equality before the law provision, the exception clause, the restitution provision, the implementation provisions, and the definitions of terms. The Explanation is an integral part of the constitution and is to be read with it.

Sovereignty of the Individual

Every person is sovereign, except to the extent that a person has violated the sovereignty of another person, and has not yet made full restitution to that person, thereby restoring the integrity of the injured person as well as the sovereignty of the injurer.

Equality Before the Law

The government shall treat all persons equally, except where unequal treatment is required to protect persons against violations of their sovereignty by other persons.

Restitution

The government shall reverse its unequal treatment of persons where it occurs, so no person is advantaged or disadvantaged as a result of unequal treatment by the government. Persons who gain unequal government benefits shall return those benefits in full to the government. Persons who incur unequal government costs shall receive full restitution from the government, except those who have violated the sovereignty of another person and not yet made full restitution to the injured person.

Implementation

The Freedom Universal shall be chosen as the supreme law of the land by means of a referendum of the persons of the jurisdiction.

The Freedom Universal shall operate by means of cases brought before an independent, impartial, competent tribunal constituted for this purpose. The existing political and legal system, including all its laws, institutions, and government actions, shall not be formally changed by the adoption of the Freedom Universal, unless and until a person brings a case claiming a conflict between the Freedom Universal and a law, institution, or government action. The judgment of the tribunal shall bind and require the compliance of the government and all persons of the jurisdiction.

Persons of the jurisdiction may, by means of a two-thirds supermajority in a referendum, override tribunal judgments and temporarily implement measures that are not in compliance with the Freedom Universal's core provisions. Such noncompliant measures shall expire after no more than five years. Each implementation of a measure that is not in compliance with the Freedom Universal shall be significantly more compliant than the conditions it replaces. Thus, over time, the society shall gradually transition toward greater and greater equality before the law.

The Freedom Universal shall not be amended or repealed, except by means of three-quarters supermajorities in two consecutive referendums of the persons of the jurisdiction, spaced at least three years apart.

Definitions

Person means individual human beings.

Property means that which a person has acquired through first possession or voluntary exchange. The concept of property is a corollary of the concept of individual sovereignty.

Violence means Coercion which means (physical) force, or the threat of force, or fraud (an indirect form of force).

Government means the ultimate institution of authority, backed by force, in a given jurisdiction. It has no authority of its own, except that which is delegated to it by sovereign individuals.

Treatment means all forms of action—including, without limitation, direct, indirect, explicit, implicit, tacit, written, unwritten, actual, or threatened actions, institutions, laws, rules, regulations, policies, procedures, or customs—that affect one or more persons.

Equality means Equality before the Law which means that persons are not distinguished from one another (except where required to protect persons against violations of their sovereignty).

Innocent Person means a person who has not violated the sovereignty of another person, or has restored their innocence by making full restitution to persons whose sovereignty they have violated.

Supreme Law means that the Freedom Universal prevails in any conflict with any other law.
